One of my friend got this message like for his EAD only.

Hi,
I am currently on STEM OPT and have lost my job. I have an offer from Company A but they are not willing to enroll into the eVerify system. To bypass this, they suggested that I take up employment with a consulting firm B (who is enrolled in eVerify) and then work on company A's project as a contractor through firm B. Would this be legally OK? I heard that even though I would be on company B's payroll, company A should still be registered with eVerify.
Can someone please advice on what is the legal requirement??

My fiance has a (U.S) MS degree in Chemistry but has been working on H1b as a computer programmer for the last 2 years ? All her undergraduate work has also been in the Sciences. Her GC sponsor is a software company and she will be applying as a computer programmer. Does anyone have experience with this kind of Labor Certification situation ? Thank you for any help.

Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

I am applying for H4 visa after my recent marriage with an H1B visa holder in USA. I am currently filling out the online DS160 form but stuck at the following stage: "travel information"
In the purpose of trip to USA question: the given options are business, travel or student visas, so i selected the option: "other". On selecting this, the form loads a list of further options in order to SPECIFY: the H4 option (dependent of H1B holder) is not given in this list. The nearest applicable option is "temporary employee H1, H2". When I choose this one, then at a much later stage in the application, in the section titled "temporary work visa information" the form starts to ask information on my supposed employer etc, which is clearly UN-applicable in my case, as I am NOT applying for an H1 or H2 visa. Kindly help me out, on how to proceed with DS160 in such a situation. Waiting for reply with anticipatory thanks. Sadatj.

Hi,
I just got back word from my lawyer saying that you shld be able to work with an expired EAD as USCIS would "backdate extensions of work authorisation" (provided of course that you have applied for the extension).
(I have been trying to upload the pdf, but can't seem to get it.
It's saved as a pdf on my local drive and am using the attachment icon provided, any help would be appreciated).
I know there are have been many nays on this subject and have asked my lawyer to provide more substantial proof (any memos or publications by USCIS).
Any comments on this?

Can you get AP when you are out of status anytime during your stay in USA, if you get AP can you travel outside USA and enter back using it.

hi, my wife's ead expired in 2008 and did not get it renewed as she is a housewife and is not going to work. we got her ap renewed thouht and travelled out of usa. my question is when we re-enter usa will the port of entry officials ask for a valid ead for my wife for allowing re-entry. or just valid ap is enough for re-entry.

Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"
I asked her whats the next step after this?
IO : Hope fully will be assigne to some one

IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.
Any body who has thier case in the pool of "Pending review and final decision".
Honestly, I think its just a general status that she told me about my 485 case.

I just received an 3 year h1-B extension based on an approved I-140. I had only 2 years left of 6 year h1 limit but because I have an approved I-140, I got one more year.
I attached my approved I-140 copies along with H1B extension application but the Alien number A# on this new H1-B extension approval is different than what I have on I-140 approval notice. Actually its a typo, instead of A 08 it A 008 and because of one extra zero the last digit is lost.
Is this a matter of concern? Please help.
