Hi all,
Mine is Labor Substitution with EB2 India PD is April 2005 and with the same Employer since 5 years .
6 months back my case was moved to New York (I am working in NY as a consultant ) regional center where I am working now.
I have to move to NCarolina this month end for a new assignment. What should I do now?
If I inform USCIS thru AR-11, how much time they take to transfer my case to new regional office? Worried if they take long time and dates retrogress before they transfer.
How early can I apply AR-11 and how late I must inform them?
Anybody with similar experiences? Pleas suggest me the due course of action.

Hi,
Because of some reason or the other it happend to be so bad that my I140 documents were sent by courier on Tuesday - 17 July 2007.
can any one of you please suggest what best I can do to file my 485 during this current window July 17 to Aug 17 2007.

Hi one of my relative has cleared the US citizenship exam. He is waiting for the oath. He want to visit canada after a month. Before the canada visit I think the oath will be done and he will become citizen of US. He can not get the US passport instantly.
My questions:
1. After becoming US Citizen can he visit canada without US passport? If yes what docs he needs to carry with hi?
If no then what to do ? asking because he want to visit canada and can not get passport withn 15 day.

Good MOrning All I have 2 questions:
1.) My littel sister is living with a Looser for the past 10 teays and he refuse to file for her Residency. So got pregnat last year and now has a baby by him. Is there anything she can do to get her residency in this situation?
2.) I am married to a US citizen. I have a Pending case with USCIS however it has been draging out for too long. I wanted to file for my Residency using my Current marriage. She is a US citizen however dose anyone know if there is a limit or time frame when a US citizen can file for someone else? She was married before and filed for her X-husband residency. Can she file me now without any problem?

I will be graduating in May'07. I am not eligible for OPT. I have a job offer and the company will be applying for my H1 in April. But I cannot start working before October.

It all depends if your I-140 has been filed and approved and the I-485 has been pending for 6 months+.
If your I-140 has been approved and six months have passed since the filing of the I-485 then you should have no problem working in the same/similar job capacity under AC21 provisions.
Having said that, I don't know what the USCIS would do nowadays given the really bad economy.
This is not a professional advice and you should consult a lawyer on your specific case.

I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.
I really want to work for my new employer and would like to know what other options do I have to obtain work permit in USA other than L1 Visa?

I count myself as one of the lucky ones as I already have a GC for the last two years and enjoy working in the US. However, my company has offered me a position in Europe for three years and I was wondering how this would affect my green card status. Can I put it on "hold"? If so, is it easy. Any feedback would be appreciated.

My Title is different in H1-B and GC, though it is in the same field.. I am going for stamping to Chennai in January.. Will this be a problem ? Will they ask questions about I-485 filing in H1-B stamping ?

I guess that should be OK. Only H1B rules require one to be continuously earning. On EAD, if you have a potential employer who is willing to hire you after your GC is approved, you can remain without regular paychecks.
I know of the guys, who actually availed unemployment benefits on EAD, and yet got their GCs. At least sitting without regular paychecks is better than that.

I am planning to get my H1B extension Visa stamped in Montreal, Canada. i am in US right now. I have completed the online application. I have paid the fee through my credit card and the status of the transaction is showing as "Pending" in my bank account. I can able to see "MRV Fee Receipt Number". i can also able to see Schedule Appointment First Available: Friday, November 12, 2010 09:30 AM. But I am not able to schedule an appointment. All of the steps I performed on Yesterday. So I have waited for today for any changes and all remains the same.
Please help me.
